SB 1374 – Restraining Orders: Educational Institutions

Summary: Higher education campuses receive credible threats of violence or harm, often causing fear amongst the campus university and surrounding community. Threats cause disruption and result in lower student attendance which leads to cancellation of classes or community events.

Campuses work with appropriate law enforcement agencies to investigate threats to ensure they are credible to ensure campus safety for students, faculty, and staff.

Under existing law, universities may seek a restraining order on behalf of a student or employee who has suffered a credible threat of violence.

Senate Bill 1374 authorizes a public higher education institution to seek a temporary restraining order or injunction on its own behalf when it faces unlawful violence or a credible threat of violence, even if the threat is not directed at a specific individual. This bill will provide stronger legal tools to ensure institutions are able to maintain safe learning environments.
